New Delhi: The Supreme Court on Thursday rejected the plea by Kolkata-based AMRI hospital, which had sought one-year extra time to pay the compensation of over Rs 11.5 crore in a case of death due to medical negligence.
Dr Kunal Saha, a US-based professor and private consultant in HIV/AIDS, is known for his struggle against a case in which his wife, Anuradha Saha, died at the age of 36 at Kolkata-based Advanced Medicare Research Institute (AMRI) of medical negligence on May 28, 1998.
Kolkata: Calcutta High Court on Monday directed 17 Kolkata doctors and ex-members of West Bengal Medical Council (WBMC) to stand trial for alleged “criminal conspiracy” and “screening offender”.
Kolkata: AMRI Hospital and three prominent doctors of Kolkata — Dr Sukumar Mukherjee, Dr Baidyanath Halder and Dr Balaram Prasad — on Tuesday paid a compensation of Rs 1.2 crore to the National Consumer Disputes Redressal Commission (NCDRC) for causing death of Anuradha Saha, who expired in 1998, due to medical negligence.
“The metropolitan magistrates court has found 17 members of the WBMC (West Bengal Medical Council) prima facie guilty of criminal conspiracy and has issued summons (Bankshall Court Order / August 19, 2011). The criminally indicted doctor members of the council have no legal or moral right to continue as members. We demand their immediate removal,” says Dr Kunal Saha who heads the People for Better Treatment, a non-governmental organisation (NGO) fighting against medical negligence.
The National Consumer Disputes Redressal Commission (NCDRC) has awarded a compensation of Rs 1.73 crore to be paid by three Kolkata doctors — Dr Sukumar Mukherjee, Dr Baidyanath Halder and Dr Balaram Prasad — and the Advanced Medicare Research Institute (AMRI) hospital in Kolkata to US-based Dr Kunal Saha for the death of his wife Anuradha Saha while undergoing treatment at the hospital in 1998.
