Hospital fined Rs 7 lakh for not taking consent before inserting catheter in a patient

New Delhi: The National Consumer Disputes Redressal Commission (NCDRC) has held Sitaram Bhartia Institute of Science and Research guilty of negligence for not taking consent before inserting a catheter for central venous line procedure in a patient and directed the Delhi-based hospital to pay a compensation of Rs 7 lakh to him.

In its order dated May 5, a bench of Justice Ajit Bharihoke and Anup K Thakur said doctors must take consent of a patient or his family members for any invasive procedure during treatment. The provision of taking consent could be overlooked only if urgent intervention was required to save the life of a patient, the bench added.

Advocate Nikhil Jain, appearing for the patient, contended that the doctors had not taken consent of the family members and alleged that due to their negligence, the patient’s jugular artery was ruptured resulting in profuse bleeding and he had to be shifted to another hospital for treatment, reports ToI.

    Exactly so…dr.prashant, u these ppl r never competent to even properly state a medicolegal issue. Obviously they publish biased stories against Medical fraternity… to satisfy political interests & also to satisfy hateful commoners & hooligans. Either they do so willfully, avoiding d whole story….or they do so ignorantly, by uttering gibberish/stupid terms & prove that they r always incompetent to judge a medico. Only an expert medico can judge an apparently accused medico.
    They r not even providing ppl the latest ammendment stated by d honorable supreme court regarding​ d application of d term “negligence” against docs & lawyers.

    There is no such thing as jugular artery…..So how did they rupture it??……
    Atleast article should be reviewed be publishing.
